Terms of Service (Terms & Conditions)

**Applies to:** G J Chappell Consulting and Sage Success Personal & Professional Development (“we,” “us,” “our”) and our websites, programs, memberships, events, and online materials (collectively, the “Services”).
By accessing the website or using our Services, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Services.
We provide counselling, coaching, education, groups, programs, and memberships. Some offerings are educational and not a substitute for medical, psychological, legal, accounting, or other professional advice.
You must be the age of majority in your province/state (or have guardian consent) to use our Services. We may decline or discontinue service at our discretion (e.g., scope mismatch, conflicts of interest, capacity).
Our Services are not suitable for emergencies. If you are in crisis or at risk of harm, call local emergency services (e.g., 911 in Canada/US) or your local crisis line.
Scheduling may be handled by third-party tools (e.g., Calendly, practice software). You are responsible for keeping your contact and payment information current. Where accounts/portals are used, safeguard your login and notify us of any unauthorized access.
All content we provide (e.g., courses, handouts, videos, worksheets, frameworks, trademarks, and logos) is owned by us or our licensors and protected by intellectual property laws.
License: We grant you a personal, non-exclusive, non-transferable license to use materials for your own learning during and after your enrolment.
Restrictions: You may not copy, share, resell, redistribute, or create derivative works from our materials without prior written permission. Group, corporate, or teaching use requires a separate license.
If you submit content (e.g., discussion posts, homework, testimonials), you grant us a non-exclusive license to use it to operate the Services. Testimonials are voluntary; you may choose your display preference (full name, first name + initial, or anonymous). You can withdraw consent for future use; previously printed/published materials may not be retractable, but we will remove the testimonial from our website going forward.
Be respectful, inclusive, and maintain confidentiality of other participants’ stories. No harassment, hate speech, spam, or solicitation. We may moderate, remove content, or suspend access to protect community safety.
Client information is handled according to professional standards and our Privacy Policy. Legal/ethical exceptions to confidentiality may apply (e.g., imminent risk of harm, abuse/neglect, court order).
Educational scope: Many Services (courses, membership, resources) are educational and coaching-oriented. They are not medical, psychological, psychiatric, legal, financial, or accounting advice.
No guarantees: We do not promise specific outcomes (e.g., employment, income, clinical results). Your results depend on many factors beyond our control.
Third-party tools: We are not responsible for third-party websites, platforms, or tools we link to or embed.
Fees are listed at checkout/booking. Applicable taxes (e.g., GST/PST/HST) may be added. You authorize us or our payment processor to charge your selected payment method for purchases, subscriptions, and renewals until canceled under the applicable policy.

To protect privacy, no recording (audio/video/screenshots) of sessions or group calls is permitted without explicit mutual consent.
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill arising from your use of the Services. Our total liability for any claim is limited to the amount you paid for the Service giving rise to the claim in the 3 months preceding the event.
You agree to indemnify and hold us harmless from claims, damages, and expenses (including reasonable legal fees) arising from your misuse of the Services or breach of these Terms.
We may modify or discontinue features or content to improve quality or for operational reasons. Where a material change affects prepaid access, we will provide a reasonable alternative, prorated credit, or refund per our policies.
These Terms are governed by the laws of the Province of Saskatchewan and the laws of Canada applicable therein. Disputes will first be addressed by good-faith negotiation, then (if unresolved) non-binding mediation in Saskatchewan, and finally small claims or a court of competent jurisdiction in Saskatchewan.
